This Agreement sets the standards and responsibilities for owners who list vehicles and receive enquiries through DRVN.
Effective date11 October 2026OperatorDRVN MarketplaceContactowners@drvnmarketplace.com.au
1. Scope and relationship
This Owner Agreement applies when you create an owner account, purchase a listing membership, submit or manage a vehicle listing, receive Contact Unlock activity or communicate with Customers through information obtained from DRVN.
You operate independently. Nothing creates employment, partnership, agency, franchise or authority to bind DRVN.
2. Eligibility and authority
You must be at least 18 and legally capable of contracting.
You must own the vehicle or have documented authority from the owner to list and offer it.
You must be authorised to provide every service selected in the listing.
Business owners must have authority to bind the business.
You must promptly update identity, business and contact details.
3. Membership, billing and listing limits
An active eligible membership may be required to submit or keep listings live. The selected plan controls listing capacity and features. Memberships may renew automatically until cancelled through the subscription-management tools.
If a membership expires, pauses, fails payment or is downgraded, listings above the available limit may be paused. Cancellation and refunds are governed by the Refund Policy and mandatory law.
4. Listing submission and approval
You must provide complete vehicle details, clear images, an accurate public location, realistic travel radius, permitted service categories, unlock price and current private contact details.
DRVN may approve, reject, request changes, format, pause or remove a listing to protect quality, legality, safety and marketplace integrity. Approval is not a legal, mechanical or insurance certification.
5. Accuracy and ongoing updates
All claims must be accurate, supportable and not misleading, including make, model, year, ownership, condition, power, modifications, seating, service categories, availability statements, location, travel radius and verification claims.
You must promptly disclose material changes, defects, modification changes, insurance changes, licence changes, safety incidents, defect notices or anything that makes the listing inaccurate or the proposed service unsuitable.
6. Ownership and third-party rights
You confirm that listing the vehicle and uploading content does not infringe another person's copyright, trade mark, privacy, confidentiality, publicity or contractual rights. Where another person appears in media, you must have permission to use their image where required.
7. Service categories
You may only select services you are genuinely willing and able to discuss. Categories may include static display, photoshoot, film, brand activation, event appearance or passenger transport where lawful.
Do not imply that a display-only, competition, conditionally registered or otherwise restricted vehicle is available for road or passenger use when it is not.
8. Passenger transport and regulated services
If you offer passenger transport, chauffeured services or any regulated service, you are solely responsible for identifying and maintaining every licence, driver authorisation, booking authority, vehicle authority, inspection, registration classification, CTP category, commercial insurance, signage, record or training requirement that applies in each jurisdiction.
You must not rely on DRVN, a listing approval or a customer request as evidence that a service is lawful. On request, you must provide current evidence reasonably required to assess a compliance concern.
9. Vehicle condition, modifications and road use
You must keep the vehicle safe, maintained and suitable for every service offered. All modifications, seating, restraints, tyres, brakes, suspension, lighting, emissions, noise, structural changes and safety equipment must comply with applicable law and approvals.
Competition-only, defected, unsafe, unregistered or restricted vehicles must not be offered for prohibited road use or passenger transport. Static display and closed-course services must be accurately described and separately risk-assessed.
10. Insurance
You must hold all insurance reasonably required for the services you provide, including compulsory insurance and appropriate comprehensive, commercial, public liability, passenger transport, event, motorsport or business-use cover as applicable.
You must disclose the vehicle's modifications and commercial use to insurers where required. DRVN does not arrange, verify or guarantee insurance unless a specific badge expressly says what was checked.
11. Safety and driving conduct
Obey all road, venue and event rules.
Do not perform burnouts, drifting, racing, launches, excessive acceleration, speed demonstrations or other dangerous conduct on public roads.
Do not drive while impaired, fatigued, unlicensed or medically unfit.
Do not allow a customer to pressure you into unlawful or unsafe conduct.
Use appropriate restraints and do not exceed lawful seating capacity.
Stop or refuse a service when safety or legality is in doubt.
12. Minors and vulnerable passengers
Where an enquiry involves a minor, school formal or vulnerable person, confirm the identity and authority of the responsible adult, obtain appropriate consent, use lawful restraints and follow all child-safety, passenger and event requirements.
Do not communicate inappropriately with minors or attempt to move arrangements away from the responsible adult without a legitimate reason.
13. Pricing, quotes and representations
You set your own Owner Service price. Quotes must clearly state what is included, additional charges, deposits, travel, overtime, waiting time, cancellation terms, payment method and any conditions.
Do not use bait pricing, hidden mandatory fees, false scarcity, misleading discounts or pressure tactics.
14. Direct customer agreement and payment
The Owner Service contract is between you and the Customer. You are responsible for providing written confirmation of the agreed scope, price, payment, cancellation, refund, timing and safety terms.
Under the current directory model, DRVN does not collect the Owner Service payment or hold it on trust. You are responsible for receipts, invoices, tax records and lawful payment handling.
15. Cancellations, delays and no-shows
Your cancellation terms must be fair, clear and disclosed before payment. Consider weather, mechanical failure, illness, event changes and circumstances outside either party's control.
Communicate delays or cancellations promptly and provide remedies required by the direct agreement and applicable law.
16. Taxes and business obligations
You are responsible for determining whether your activities constitute a business, registering where required, reporting income, accounting for GST or other taxes, and complying with record-keeping, employment and contractor obligations.
17. Contact details and response standards
Keep unlocked contact details current and monitored. Respond professionally within a reasonable time or update the listing when you are unavailable for an extended period.
Do not use Customer details for unrelated marketing unless you have valid consent. Do not add Customers to mailing or SMS lists merely because they unlocked your details.
18. Listing content licence
You retain ownership of your content and grant DRVN the licence described in the Marketplace Terms to host, format, display and promote the listing and marketplace.
DRVN may crop, resize or adapt media for website and social placement without materially misrepresenting the vehicle.
19. Reviews, complaints and conduct
You must not manipulate reviews, retaliate against a reviewer, offer undisclosed rewards for positive reviews or pressure a Customer to remove genuine criticism. You may provide a factual response and submit evidence through DRVN's dispute process.
20. Records and cooperation
Keep records reasonably necessary to support your listing, legal compliance, insurance, quotes, agreements, payments, cancellations and incidents. Cooperate with reasonable platform investigations and preserve relevant evidence.
21. Pausing or removing listings
DRVN may pause or remove a listing where membership capacity is lost, contact details fail, material information is inaccurate, complaints raise a credible safety concern, documents expire or platform rules are breached.
Where appropriate, DRVN will explain the reason and allow a response, unless immediate action is reasonably required.
22. No guarantee of leads or earnings
DRVN does not guarantee views, saves, Contact Unlocks, enquiries, revenue, ranking or a particular number of events. Marketplace demand varies by vehicle, location, season, price, presentation and other factors.
23. Responsibility for Owner Services
You are responsible for your vehicle, conduct, direct agreements and Owner Services. To the extent permitted by law, DRVN is not liable for loss arising from your vehicle, driving, staff, contractors, customer agreement or service performance, except to the extent caused by DRVN's own breach, negligence or unlawful conduct.
24. Ending the Owner relationship
You may stop listing and cancel future membership renewals through the available tools. DRVN may terminate owner access for serious or repeated breaches, fraud, safety risks, unlawful conduct or non-payment, subject to applicable law and reasonable process.
Terms relating to payments, content already used, records, disputes, liability and legal compliance survive termination where necessary.
25. Governing law
This Agreement is governed by the laws of Queensland, Australia. This does not remove mandatory rights that apply under Australian Consumer Law or another applicable law.
