Marketplace Terms

These Marketplace Terms apply when you browse, create an account, save a vehicle, purchase contact access, submit content, communicate through DRVN or otherwise use the marketplace. By using DRVN, you agree to these Terms and the policies incorporated by reference.

If you use DRVN on behalf of a company, organisation or another person, you confirm that you have authority to bind that party.

Customer means a person seeking a vehicle or owner contact. Owner means the independent person or business responsible for a listed vehicle. Contact Unlock means the digital product that gives an eligible purchasing account access to approved owner contact details. Owner Service means any transport, appearance, display, photography, film, event or other service later discussed with an owner. Listing means a vehicle profile displayed on DRVN.

• You must be at least 18 years old and capable of entering a binding agreement to create an account or make a purchase.
• You must provide accurate information and keep account details current.
• You are responsible for activity carried out through your account and for protecting access to your email and sign-in method.
• You must promptly notify DRVN of suspected unauthorised access.
• DRVN may request information reasonably required to verify an account, transaction, listing or safety concern.

DRVN may provide vehicle discovery, search and radius tools, saved listings, owner memberships, listing submission and moderation, analytics, reviews, reports, Contact Unlocks, account tools and support.

Features may change over time. Where a material change affects a paid ongoing service, DRVN will provide reasonable notice where practicable and will comply with applicable consumer law.

DRVN does not determine whether an owner is available, set the price or terms of an Owner Service, accept the later service booking, collect the owner's service payment, dispatch a vehicle or driver, supervise performance or guarantee that the parties will proceed.

Any Owner Service is a separate agreement directly between the Customer and Owner. Each party is responsible for assessing the other party, agreeing clear terms and complying with applicable laws.

A Contact Unlock purchases digital access to contact information for a specific listing. It does not purchase or reserve the vehicle, guarantee a reply, guarantee availability, include the Owner Service price or create an obligation for an owner to accept an enquiry.

Contact Unlocks are also governed by the Contact Unlock Terms and Refund Policy.

Owners may need an active membership to submit or maintain listings. Membership inclusions, listing limits, billing frequency and price are displayed before purchase. Memberships may renew automatically until cancelled through the available subscription-management tools.

Cancelling usually prevents the next renewal and may affect listing capacity or publication. Refunds are governed by the Refund Policy and mandatory law.

Listing information is supplied primarily by owners. Owners must keep it accurate, current and not misleading. DRVN may review presentation, request evidence, edit formatting, reject or pause content, but does not guarantee every statement or omission has been independently verified.

Public locations and map markers are approximate. Search results and ranking may consider relevance, location, travel radius, category, membership features, recency, quality and platform integrity.

Before entering an Owner Service agreement, the parties should confirm the date, time, pickup or venue details, service scope, price, deposit, cancellation terms, passenger details, route, travel, photo or display permissions, insurance expectations and any legal or safety requirements.

DRVN is not responsible for negotiating or enforcing those direct terms, but may assist with platform-related records, reports or safety investigations.

Passenger transport, chauffeured services and other regulated activities can require licences, authorities, inspections, registration classifications, insurance or other approvals that vary by jurisdiction. Owners must only advertise and provide services they can lawfully and safely perform.

A DRVN listing or category selection does not authorise an otherwise unlawful service. Customers should ask owners for relevant evidence when the proposed service involves passenger transport or another regulated activity.

DRVN fees are displayed before checkout and processed through Shopify and the selected payment provider. You authorise the charge shown at checkout, including applicable taxes.

Owners and Customers are responsible for taxes, invoices, receipts and payment obligations arising from their separate Owner Service arrangement. DRVN does not process that later payment under the current directory model.

Reviews must reflect a genuine interaction and must not be fake, misleading, abusive, discriminatory, defamatory, coordinated or posted in exchange for an undisclosed benefit. DRVN may request evidence, label, restrict or remove reviews to protect marketplace integrity.

Moderation is not an endorsement of every remaining review.

You retain ownership of content you submit. You grant DRVN a non-exclusive, worldwide, royalty-free licence to host, reproduce, resize, format, display, distribute and promote that content for operating and marketing the marketplace, including on DRVN websites, apps, social channels and advertising.

You confirm you have the rights and permissions needed for submitted photos, videos, logos, descriptions and personal information. You may request removal, subject to records DRVN must retain for legal, safety or dispute purposes.

DRVN branding, software, layouts, marketplace data, graphics and original content are protected by intellectual property laws. Except as permitted by law or written permission, you must not copy, reverse engineer, scrape, republish, sell or create a competing database from DRVN content.

You must comply with the Acceptable Use Policy. Prohibited conduct includes unlawful listings, dangerous-driving promotion, harassment, discrimination, contact harvesting, spam, impersonation, fake reviews, malware, security interference and misuse of unlocked contact details.

Any verification badge has only the meaning stated with that badge. Unless expressly stated, DRVN does not certify identity, ownership, mechanical condition, roadworthiness, modification approval, licensing, insurance or suitability.

Users must exercise independent judgment and take reasonable precautions. Do not rely on a listing as a substitute for professional, legal, mechanical or insurance advice.

DRVN relies on third-party services including Shopify, payment providers, hosting, mapping, subscription and communication tools. Their terms and privacy practices may also apply. DRVN is not responsible for an external service outside its reasonable control, but will take reasonable steps to maintain its own services and communicate material disruptions.

DRVN may restrict content or accounts where reasonably necessary to investigate suspected fraud, safety risk, unlawful conduct, payment failure, security threats, repeated complaints or policy breaches. Where appropriate, DRVN will give notice and an opportunity to respond, unless immediate action is reasonably required to protect users, evidence, the platform or the public.

You may stop using DRVN at any time. Account closure does not remove accrued payment obligations, completed transactions or provisions intended to survive termination.

Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy that cannot lawfully be excluded, including rights under the Australian Consumer Law.

Where DRVN is permitted to limit a remedy for a service, the limitation will apply only to the extent permitted by law.

To the extent permitted by law, DRVN does not guarantee uninterrupted access, search ranking, owner response, listing availability, successful negotiation, service quality, earnings, leads or a particular outcome. Marketplace information may change and may contain owner-supplied errors.

To the extent permitted by law, DRVN is not liable for indirect, special or consequential loss, loss of opportunity, reputational loss or loss arising from a direct Owner Service agreement, except to the extent caused by DRVN's breach, negligence or unlawful conduct.

Any monetary limitation will not apply where it would be unlawful, including for liability that cannot be limited under the Australian Consumer Law.

You are responsible for loss reasonably arising from your breach of these Terms, unlawful conduct, infringement of third-party rights, misuse of personal information or negligent provision of an Owner Service. This does not require you to compensate DRVN for loss caused by DRVN's own negligence, breach or unlawful conduct.

Contact support@drvnmarketplace.com.au with relevant account, listing and transaction details. DRVN will assess platform-related complaints and may request evidence. Users should first try to resolve direct Owner Service disputes with the other party.

Nothing prevents a consumer from contacting an applicable state or territory consumer protection agency, the ACCC, the OAIC or another regulator where relevant.

DRVN may update these Terms to reflect legal, security, operational or service changes. Material changes will be notified through the website, account or email where reasonably practicable. Changes will apply prospectively from the stated effective date, except where immediate action is required by law or to address an urgent security risk.

These Terms are governed by the laws of Queensland, Australia, and the parties submit to the courts of Queensland and courts entitled to hear appeals from them. This clause does not remove any mandatory rights a consumer has in another jurisdiction.
